1. ACCEPTANCE OF TERMS
By accessing or using the Elite Remote Learning application or website (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service. These Terms apply to all users, including parents, guardians, students, and visitors.

3. ELIGIBILITY AND PARENTAL CONSENT
Elite Remote Learning is designed for South African students from Grade R to Grade 12.
- Users under 18 years of age MUST have parental/guardian consent
- Parents/guardians must provide valid contact information
- Parents/guardians are responsible for monitoring their child's use
- The account holder (subscriber) must be 18 years or older
- One subscription per parent/guardian, used for their family
- Email verification required before service activation
4. SUBSCRIPTION AND PAYMENT
4.1 Pricing
We offer two subscription plans:
- Single Plan R149/month: 1 child profile, use on 1 device at a time.
- Family Plan R300/month: Up to 3 child profiles, each with their own grade and language, use on up to 3 devices at a time.
Both plans include a 7-day free trial. Prices are in South African Rand (ZAR), inclusive of VAT where applicable. No setup fees or hidden charges.
4.2 Free Trial
- New subscribers receive a 7-day free trial through Google Play
- You will NOT be charged during the trial
- You will be charged your plan price (R149 or R300) after 7 days unless you cancel
- One free trial per customer/household
- This serves as your CPA cooling-off period
4.3 Subscription & Billing
- All subscriptions are billed through Google Play Billing
- By subscribing, you authorize Google Play to charge your chosen plan monthly until cancelled
- Your subscription automatically renews each month through your Google account
- Google Play sends you a receipt for each charge
- You can cancel anytime through Google Play Subscriptions
- Cancellation takes effect at the end of the current billing period
4.4 Payment Processing
- Payments are processed securely by Google Play Billing
- We do NOT store, see, or handle your card details
- Google Play manages all billing, card data, and security
- Refunds are subject to Google Play's policies in addition to our Refund Policy
5. USE OF THE SERVICE
5.1 Permitted Use
- Personal, non-commercial educational use only
- For the registered subscriber and their family members
- For supplementary learning support, not a replacement for formal education
- Single Plan is for 1 child on 1 device; Family Plan is for up to 3 children on up to 3 devices
5.2 Device Limits & Account Sharing
To protect against unauthorized sharing, each plan has a device limit:
- Single Plan allows 1 device at a time
- Family Plan allows 3 devices at a time
- If you log in on more devices than your plan allows, the oldest device is automatically logged out
- Your account is for your household only
- Sharing login credentials with people outside your household is prohibited
5.3 Prohibited Use
You may NOT:
- Share your account credentials with anyone outside your household
- Use the Service for cheating on exams or assessments
- Reverse engineer, decompile, or extract our source code
- Use automated systems (bots, scrapers) to access the Service
- Resell, redistribute, or commercialise our content
- Upload malicious content, viruses, or harmful code
- Harass, threaten, or harm other users or our staff
- Submit false information or impersonate others
- Use the Service for any illegal purposes
- Create multiple accounts to abuse the free trial
6. AI TUTORING DISCLAIMER
Elite is our AI tutoring assistant powered by industry-leading language model technology:
- AI responses are for educational support, not professional advice
- AI can occasionally make mistakes - verify important information
- Elite Remote Learning is supplementary - not a replacement for school
- We do NOT issue formal qualifications or certificates
- Final exam results are not guaranteed by using our Service
- AI responses are generated, not human-written
7. ACCOUNT SECURITY
You are responsible for maintaining confidentiality of your login credentials, all activities under your account, notifying us of unauthorised access, using strong passwords, keeping your email current, and not sharing accounts with people outside your household.
8. CANCELLATION AND TERMINATION
8.1 Your Right to Cancel
- Cancel anytime through Google Play Subscriptions

- NO cancellation fees
- Access continues until end of paid period
- Google Play sends a cancellation confirmation
8.2 Our Right to Terminate
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behaviour, misuse the AI system, or are deemed a security risk to other users.
8.3 Effects of Termination
- Immediate loss of access to the Service
- Data deletion within 30 days
- No refund of subscription fees if terminated for cause
9. INTELLECTUAL PROPERTY
- All Elite Remote Learning content, branding, and software is our intellectual property
- You receive a limited, non-transferable license to use the Service
- You may NOT copy, modify, or redistribute our content
- Content you upload (photos, questions) remains yours
- You grant us license to process uploaded content for service delivery
10. PRIVACY AND DATA PROTECTION
We are committed to protecting your privacy in compliance with POPIA. Please review our Privacy Policy. We never sell your personal information, data is encrypted and stored on SA servers, you can request deletion anytime, and parental consent is obtained for users under 18.
11. LIMITATION OF LIABILITY
- We provide the Service "as is" without warranties
- We are not liable for indirect or consequential damages
- Our maximum liability is limited to fees paid in the past 12 months
- We are not responsible for educational outcomes (grades, exam results)
- We are not responsible for content generated by users
12. SERVICE AVAILABILITY
- We aim for 99% monthly uptime
- Scheduled maintenance announced 48 hours in advance
- Service may be unavailable during load-shedding or internet outages
- Service outages over 24 consecutive hours = pro-rata refund
13. GOVERNING LAW
- These Terms are governed by the laws of the Republic of South Africa
- Disputes shall be resolved in SA courts (Gauteng Division)
- Mediation will be attempted before litigation
- These Terms are subject to the Consumer Protection Act
14. CONSUMER PROTECTION ACT RIGHTS
Your rights under the SA Consumer Protection Act are NOT limited by these Terms, including: a 7-day cooling-off period (free trial), the right to fair business practices, the right to clear information, the right to lodge complaints with the National Consumer Commission, and the right to fair value for money.
15. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Elite Remote Solutions regarding the Service.
